Dear Consultee,

At a meeting on 21 October 2021 Cabinet agreed to make and serve an Article 4 Direction at Hainault Business Park to replace the existing Immediate and Non-immediate Article 4 Directions in operation at the park, served on 18 January 2021 and confirmed in May and July 2021 respectively. The new Direction is necessary as due to government changes to permitted development rights the existing Article 4 Directions will lapse and no longer be effective after 31 July 2022.

The new Article 4 Direction will remove permitted development rights for changes of use to protect the park from the pressures of existing and new permitted development rights. The proposed new Article 4 Direction would remove the following permitted development rights:

a. changes of use from Use Class E(g) office, research and development of products/processes, and

industrial process to Use Class C3 residential use, under Class MA of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) (the GPDO);

b. changes of use from Use Class B8 storage or distribution centre, to Use Class C3 residential use, as permitted by Class Pof the GPDO; and

c. demolition of buildings in office, research and development, and light industrial use and the replacement of a single building for residential use as permitted by Class ZA of the GPDO.

The new Article 4 Direction was made on 27 October 2021 and served on 1 November 2021 under Article 4(1) of the Town and Country Planning (General Permitted Development) (England) Order 2015. A 6-week consultation period has been arranged between 1 November and 13 December 2021 to receive comments from businesses at Hainault Business Park. After the consultation period has ended Cabinet Members will decide on the confirmation of the new Article 4 Direction. If confirmed the Article 4 Direction will come into force on 1 August 2022, the day after the existing confirmed Article 4 Directions at Hainault Business Park will lapse and no longer be effective (31 July 2022).
